ROUTESIDEKICK TERMS
RouteSideKick Terms of Service
Effective date: October 7, 2026
These Terms of Service (“Terms”) govern access to and use of RouteSideKick.
RouteSideKick is provided by Nebijane LLC (“Nebijane,” “we,” “us,” or “our”), a Florida limited liability company.
RouteSideKick is in development and is not yet generally available. These Terms apply to any access Nebijane provides before general availability, such as early-access, pilot, or evaluation use, and to later use of the service.
By creating an account, accessing RouteSideKick, or using it on behalf of a business, you agree to these Terms. If you do not agree, do not use the service.
1. The Service
RouteSideKick is software for recurring field-service businesses that visit customer locations on a schedule. It is being built to help businesses keep customer and service-location records, plan recurring service, schedule appointments, assign technicians, organize the service day into routes, and record the status of each visit, as those features are implemented in the product.
Feature availability depends on the current product. Marketing descriptions do not guarantee that every described capability is available today or will remain unchanged.
2. Development Status and Early Access
Nebijane may make RouteSideKick available to selected businesses before general availability. Early-access or pilot versions may be incomplete, may change significantly, and may contain errors.
Nebijane may limit, change, or end early access at any time. We recommend that you keep your own records of information that is important to your business during early access.
3. Business Accounts and Authority
RouteSideKick is intended for business customers, not for personal or household use.
You must provide accurate account information. The person who creates or administers a business account represents that they are at least the age of majority where they live and have authority to bind the business customer to these Terms.
The business customer is responsible for activity under its accounts.
4. Team Members, Technicians, and Permissions
Customers may give office staff, technicians, and other team members access to RouteSideKick as permitted by the product.
Customers are responsible for:
- deciding who receives access and assigning appropriate permissions;
- removing access when a team member no longer needs it;
- ensuring team members comply with these Terms; and
- the information entered about their team members.
5. Account Security
You must keep login credentials confidential, must not share accounts between people, and must notify Nebijane promptly through the Contact page if you suspect unauthorized access.
6. Customer, Location, and Service Records
RouteSideKick lets customers store records about their own customers, primary contacts, service locations and addresses, recurring service plans, appointments, and visit statuses, along with any notes or other information the product allows the customer to enter.
The customer decides what information to enter and is responsible for its accuracy, for having the right to use it, and for any notices or permissions its own customers, property owners, or team members are entitled to under applicable law.
7. Schedules, Appointments, and Routes
RouteSideKick is a planning and record-keeping tool. Schedules, appointments, technician assignments, routes, and stop order are created and controlled by the customer.
Nebijane does not guarantee that any route or stop order is the shortest, fastest, safest, or most efficient; that any appointment, arrival time, or visit will occur as scheduled; or that any technician or team member will perform as planned. Real-world conditions such as traffic, weather, road access, and staffing are outside Nebijane’s control.
Route and address information in RouteSideKick is a planning aid, not driving or navigation guidance. You remain responsible for safe driving and for complying with traffic and workplace safety laws.
8. Your Responsibilities
RouteSideKick does not provide legal, employment, payroll, tax, licensing, or safety advice, and using it does not by itself make a business compliant with any law.
Customers remain responsible for their own business operations, including how they schedule and compensate workers, how they communicate with their own customers, and any licensing, insurance, or regulatory requirements that apply to their services.
9. Acceptable Use
You agree not to:
- use RouteSideKick unlawfully or for fraudulent purposes;
- enter information you do not have the right to use;
- use RouteSideKick to track or monitor any person unlawfully or without required notice or consent;
- interfere with the security or integrity of the service;
- attempt unauthorized access to other customers’ data;
- upload malware or abusive content;
- misrepresent your identity or authority in a material way; or
- resell or misuse the service except as expressly permitted.
10. Customer Data and Our Limited License
“Customer Data” means information a customer or its users enter into RouteSideKick, including records about the customer’s own customers, service locations, appointments, and team members.
As between Nebijane and the customer, the customer retains its rights in Customer Data. The customer grants Nebijane a limited license to host, copy, process, and display Customer Data only as needed to provide, secure, support, and improve RouteSideKick, and to comply with law.
Nebijane does not sell Customer Data.
11. Privacy
Use of RouteSideKick is also subject to the RouteSideKick Privacy Policy.
12. Fees and Billing
Paid RouteSideKick plans are not currently available for purchase.
If Nebijane introduces paid plans, the price, billing interval, renewal, and cancellation terms will be shown before you purchase, and these Terms will be updated. Nebijane will not charge you for RouteSideKick without your agreement to the applicable pricing.
13. Intellectual Property and Feedback
Nebijane and its licensors own RouteSideKick, including software, branding, documentation, and related intellectual property.
Subject to these Terms, Nebijane grants customers a limited, non-exclusive, non-transferable right to use RouteSideKick for the customer’s internal business purposes while access is provided.
If you give Nebijane suggestions or feedback about RouteSideKick, Nebijane may use them without obligation to you.
No rights are granted except as expressly stated.
14. Third-Party Services and Integrations
RouteSideKick may rely on third-party services such as hosting providers. If Nebijane makes integrations with other services available, your use of those services is subject to their own terms and privacy practices.
Nebijane is not responsible for third-party services it does not control, except as required by law.
15. Service Changes and Availability
Nebijane may add, modify, or remove features as RouteSideKick develops.
Nebijane does not currently publish a formal uptime SLA for RouteSideKick. We aim to keep the service available and reliable, but interruptions may occur, especially before general availability.
16. Suspension and Termination
Nebijane may suspend or terminate access for material breach, unlawful use, security risk, or other misuse, or if Nebijane ends early access or discontinues RouteSideKick.
Where reasonably practicable, Nebijane will give notice before ending access for reasons other than breach, misuse, or security risk.
Either party may terminate as permitted by these Terms and applicable law.
17. Disclaimers
To the maximum extent permitted by law, RouteSideKick is provided “as is” and “as available.”
Nebijane does not warrant that the service will be uninterrupted, error-free, or fit for every particular purpose.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Nebijane will not be liable for indirect, incidental, special, consequential, cover, or punitive damages, or for lost profits, revenue, goodwill, or data, arising out of or related to RouteSideKick or these Terms.
To the maximum extent permitted by applicable law, Nebijane’s aggregate liability arising out of or related to RouteSideKick or these Terms will not exceed the greater of the amounts paid by the customer to Nebijane for RouteSideKick during the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars (US$100).
Nothing in these Terms limits liability where limitation is prohibited by law.
19. Indemnification
To the extent permitted by law, the customer agrees to defend and indemnify Nebijane against third-party claims arising from:
- Customer Data;
- the customer’s unlawful use of RouteSideKick; or
- the customer’s violation of these Terms,
except to the extent caused by Nebijane’s willful misconduct or where prohibited by law.
20. Governing Law and Disputes
These Terms and any dispute arising out of or relating to RouteSideKick will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute that is not otherwise resolved informally will be brought in a court of competent jurisdiction in Florida, unless applicable law requires otherwise.
These Terms do not impose arbitration.
Nothing in this section limits rights or remedies that cannot lawfully be waived or restricted.
21. Changes to These Terms
We may update these Terms as RouteSideKick and applicable requirements change. If Nebijane introduces features such as time tracking, photo uploads, messaging to a business’s own customers, device location, or paid plans, these Terms will be updated before those features are made available.
When we make material changes, we will update the effective date and, where appropriate, provide additional notice.
Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
